Terms of Service

These Terms of Service ("Terms") govern your use of PostedIn, available at usepostedin.com (the "Service"), operated by Simple Studio Piotr Hyra, a sole proprietorship registered in Poland at ul. Wręczycka 90, 42-133 Bieżeń, Polska (NIP: 5742060804, REGON: 365542882) ("we", "us"). By using the Service, you agree to these Terms in full.

1. About the Service

PostedIn is an AI-powered LinkedIn post generation and scheduling platform. The Service enables: AI content generation, saving and managing writing styles, scheduling and auto-publishing posts to LinkedIn, and tracking post history.

2. Account Registration

To use the Service, you must register an account with accurate information. You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately of any unauthorised access. Accounts are personal and non-transferable.

You may sign up using email and password. Connecting your LinkedIn account is optional and required only for post scheduling and publishing features.

3. Subscriptions and Payments

3.1 Plans

The Service offers a free plan with limited features and paid subscription plans (Starter, Pro, Agency) billed monthly or annually. Plan details are available on the pricing page.

3.2 Billing

Payments are processed by Stripe. Subscriptions automatically renew at the start of each billing period unless cancelled before the renewal date. Prices are listed in PLN or USD.

3.3 Cancellation

You may cancel your subscription at any time from account settings. Access to paid features remains active until the end of your paid period. We do not offer refunds for partially used billing periods, except as required by law.

3.4 EU Right of Withdrawal

EU consumers have the right to withdraw from a contract within 14 days of conclusion, unless the service has been fully performed with their express consent. By accessing the Service immediately after purchase, you acknowledge that the right of withdrawal may lapse upon full use of the service during that period.

3.5 VAT

Stripe will automatically include or exclude tax based on the currency of the purchase. For USD and CAD, tax will be excluded from the price, so it will be added on top of the price shown to the customer. For all other currencies, tax will be included in the price, so the price shown will include the tax amount.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Generate content that infringes third-party rights, is offensive, unlawful, or constitutes spam;
  • Use the Service for mass unsolicited messaging;
  • Violate LinkedIn's Terms of Service;
  • Attempt unauthorised access to the Service's systems;
  • Resell or commercially distribute access without our consent;
  • Overload the Service's infrastructure through automated actions.

5. AI-Generated Content

Content generated by the Service is created algorithmically based on your inputs. We do not guarantee the accuracy, originality, or suitability of AI-generated content. You are solely responsible for reviewing, editing, and publishing any generated content. We accept no liability for content you publish on LinkedIn or its consequences.

6. LinkedIn Integration

Using post scheduling features requires connecting a LinkedIn account. You bear sole responsibility for complying with LinkedIn's Terms of Service. We may be required to suspend LinkedIn features if LinkedIn changes its API or policies, with no refund obligation.

7. Intellectual Property

7.1 Our Rights

The Service, its source code, design, logo, and branding are owned by us or licensed to us. You may not copy, modify, distribute, or create derivative works without our written consent.

7.2 Your Content

You retain full ownership of your input data and the content you create using the Service. You grant us a limited, non-exclusive licence to process your content solely to provide the Service.

8. Privacy

The handling of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for:

  • Service interruptions, errors, or data loss;
  • AI-generated content or the consequences of publishing it;
  • Indirect, incidental, special, or consequential damages;
  • Losses arising from LinkedIn policy violations or LinkedIn account suspension.

Our total liability to you shall not exceed the fees you paid us in the preceding 12 months.

Note for EU consumers: The above limitations do not exclude or restrict your statutory consumer rights under EU law or applicable national consumer protection legislation.

10. Suspension and Termination

We may suspend or delete your account for: breach of these Terms, non-payment, or actions that may harm other users or expose us to legal liability. You may delete your account at any time from settings. Upon deletion, your data will be removed in accordance with the Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms are governed by Polish law and, where applicable, European Union law. We will seek to resolve disputes amicably. If that is not possible, disputes shall be subject to the jurisdiction of Polish courts.

EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

US users: Use of the Service is voluntary. We do not provide services in states where doing so would be unlawful. The Service is not directed at California consumers seeking rights exclusively under CCPA.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

13. General

If any provision of these Terms is found to be invalid, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and us regarding use of the Service.
